Terms and Conditions of Service

HKG Ship Transport Service Terms and Conditions (the “Terms”)

These terms apply to the recipient of the goods (the “Recipient”) and any person with an interest in the delivery of the goods.

"Cargo" means all parcels or documents carried out under the same bill of lading, which may be carried out by HKG Ship by air, land or other means of transport.

A "bill of lading" includes a waybill, label, barcode or any equivalent electronic document generated by HKG Ship or the sender's system.

All goods are shipped on a limited liability basis; additional protection may be arranged by the sender for a separate fee.

1. customs clearance and regulatory compliance

To fulfill transportation services, HKG Ship may perform the following operations on behalf of the sender or recipient:

1.1 Complete the documents, adjust the cargo codes, and pay customs duties, taxes, or regulatory fees in accordance with the law;
1.2 Act as a legal agent or designated customs broker;
1.3 At the request of a person deemed to be an authorized representative, the goods may be diverted to another address or customs agent.

The sender/recipient shall provide the necessary authorization and cooperation in accordance with the law.

2. unacceptable goods

The following goods cannot be shipped:
• Weapons, ammunition, explosives, and imitation firearms
• Counterfeit goods, cash, precious metals, live animals, human remains or organs
• Cannabis or its derivatives, illicit substances
• Dangerous goods (as defined by ADR, IATA, ICAO or other relevant regulations)
• Restricted items listed on the HKG Ship website
• Items that are improperly packaged or whose transport safety cannot be guaranteed
• Goods or persons with a direct or indirect interest in the sanctioned entity

3. delivery and undeliverable

Goods will be delivered to the address provided by the sender, but delivery to the recipient is not guaranteed.

If delivery fails, the recipient may be offered alternative options, including rescheduling, delivery without signature, resending, or self-collection.

If the goods are deemed unacceptable, customs clearance is disputed, the recipient cannot be contacted, or the recipient refuses to pay the fees, HKG Ship may reasonably attempt to return the goods, with the related costs borne by the sender; if the goods cannot be returned, HKG Ship may choose to abandon, dispose of, or sell the goods without assuming any further liability.

If the goods are restricted by law enforcement agencies or are dangerous goods, HKG Ship has the right to destroy them directly.

4. checking rights

For regulatory or security reasons, HKG Ship has the right to open and inspect the goods without prior notice.

5. freight, customs duties and other charges

HKG Ship's freight charges are calculated based on the higher of the actual weight and volumetric weight of the goods, and the company reserves the right to reweigh and remeasure to confirm the final cost.

Freight rates are subject to various factors, including but not limited to airline pricing policies, fuel price fluctuations, route arrangements, and market demand. Therefore, freight rates may be adjusted based on the operational status of air and logistics providers at different times without prior notice.

Before placing an order or making payment, the sender should refer to the real-time shipping cost listed on the HKG Ship platform or in the notification.

Before shipment, the recipient may be required to pay customs duties, taxes or other regulatory fees in the destination country. The amount of these fees is subject to the HKG Ship official website or notices.

If HKG Ship pays the above fees on behalf of the recipient, an additional handling fee will be charged; if the recipient fails to pay, the sender shall be responsible for compensating HKG Ship for all costs and liabilities incurred.

6. limitation of liability

6.1 The maximum compensation for lost or damaged shipments is HK$1,000 per shipment. For additional protection, the sender must declare the value and purchase insurance.

6.2 HKG Ship is not liable for profits, revenue, business opportunities or any indirect losses.

The delivery times shown in 6.3 are for reference only and are not a binding commitment. HKG Ship shall not be liable for any losses caused by delays.

7. claims mechanism

Any claim must be made in writing within 7 days of HKG Ship's receipt of the shipment.

Each item is subject to only one claim, and once compensation is paid, the matter is considered fully resolved.

8. cargo insurance

The sender may proactively apply for insurance in writing and pay the premium.

The insurance only covers direct loss of the actual value of the goods, excluding delays or any indirect losses.

9. situations beyond the scope of control

HKG Ship shall not be liable for damages arising from the following circumstances:

This includes, but is not limited to, natural disasters, war, government intervention, third-party negligence, epidemics, labor unrest, information system failures, data damage, or information security incidents.

10. sender's warranties and liabilities

If you are not satisfied with our response to your complaint, you have the right to appeal to the relevant data protection authority. You can contact your local data protection authority or our regulatory body.

11. transportation routes

The sender agrees that HKG Ship has the right to decide or change the shipping route at its own discretion, including transshipment and stopover arrangements.

12. applicable law

These terms are governed by the laws of the Hong Kong Special Administrative Region and the European Union, unless they conflict with the mandatory regulations of the destination country.

13. severability of clauses

If any part of these Terms is held to be invalid or unenforceable, it shall not affect the validity and enforceability of the remaining Terms.

14. disclaimer; limitation of liability

We do not guarantee, represent or warrant that your use of our services will be uninterrupted, timely, secure or error-free.

We do not guarantee that the results obtained from using this service will be accurate or reliable.

You agree that we may remove the service indefinitely from time to time or cancel the service at any time without notice to you.

You expressly agree that you use or are unable to use this Service at your own risk. This Service and all products and services delivered to you through this Service (unless we expressly state otherwise) are provided to you on an "as is" and "as available" basis without any representations, warranties or conditions, express or implied, including all implied or conditional statements regarding merchantability, merchantability, fitness for a particular purpose, durability, title and non-infringement.

Under no circumstances shall Orionn, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers, or authorized personnel be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages, including but not limited to loss of profits, loss of revenue, loss of savings, loss of data, replacement costs, or any similar claims, whether based on contract, tort (including negligence), strict liability, or otherwise, arising out of or relating to your use of any Service or any products purchased through the Service, including but not limited to any errors or omissions in any content, or any loss or damage of any kind arising out of your use of the Service or any products, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or limitation of liability for indirect or incidental damages, our liability in those states or jurisdictions shall be limited to the maximum extent permitted by law.

15. compensation

You agree to indemnify, defend and hold harmless Orionn and its parent company, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees from and against any and all claims or demands, including reasonable attorneys' fees, arising out of or relating to your breach of these Terms of Service or through reference to the documents incorporated herein by reference, or your violation of any law or the rights of any third party.

16. termination

All obligations and liabilities incurred by the parties prior to the termination date shall remain in force and effect upon termination of this Agreement.

These Terms of Service remain in effect unless you or we terminate them. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our services or stop using our website.

If we unilaterally determine that you have failed to comply with or we suspect that you have failed to comply with any term or provision of these Terms of Service, we may terminate this Agreement at any time without notice, and you shall remain liable for all amounts due up to the termination date; and/or may therefore refuse you access to our Services (or any part thereof).

17. full agreement

Our failure to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.

These Terms of Service, along with any policies or operating rules we post on this website or related services, constitute the entire agreement and understanding between you and us and govern your use of the Services, superseding any prior or contemporaneous agreements, communications, and offers between you and us, whether oral or written (including, but not limited to, any prior versions of the Terms of Service).

In the event of any ambiguity in the interpretation of these Terms of Service, the drafter shall not be subjected to any adverse interpretation.

18. applicable law

These Terms of Service and any separate agreements under which we provide services to you shall be governed by and construed in accordance with the laws of the European Union, Hong Kong and the United Kingdom .

We reserve the right to update, change, or replace any part of these Terms of Service at our sole discretion by posting updates and changes on the website. It is your responsibility to check our website periodically for any changes. Your continued use of or access to our website or services after any changes are posted to these Terms of Service constitutes your acceptance of those changes.
